This policy explains what personal information NexusWave Digital LLC collects, why, who receives it, and the choices and rights you have. It applies to everyone in the United States, whatever state you live in.
1. Who we are
NexusWave Digital LLC (“NexusWave”, “we”, “us”) runs nexuswaveagency.com and the local service websites described below. We decide how your information is used, so we are the business (or “controller”) responsible for it.
NexusWave Digital LLC407 Lincoln Road, Ste 12-N

2. What this policy covers
This policy applies to:
- This website, where business owners ask about our partner program.
- Our local service websites and social media pages (“Network Sites”): websites and social media profiles we own and operate, under their own brands, for a type of service in a specific area, for example a roofing website for a city. Every Network Site links to this policy and names NexusWave Digital LLC as its operator.
- Phone calls, text messages and emails you exchange with us or that reach a business through our tracking numbers.
Services we provide to client businesses. When a business hires us for local SEO, an AI chatbot, automations or a website, we may handle information about that business’s own customers, for example conversations with its chatbot or records passing through its automations. We do this as a service provider, only on that business’s instructions and for that purpose, and that business’s own privacy policy applies to its customers’ information. If you’re a customer of one of our clients, contact that business first; we’ll help it answer your request.
This policy doesn’t cover the websites or practices of the partner businesses we connect you with. Once a partner business receives your request, its own privacy policy applies to what it does with your information.
3. Information we collect
We collect only what we need to answer you, connect you with a service provider, run our partner program and meet our legal obligations.
| Category | Examples | Where it comes from |
|---|---|---|
| Identifiers and contact details | Name, phone number, email, business name, city, ZIP code or street address you give us | You, through forms, calls, texts, emails and messages on social media |
| Service request details | The service you need, the problem you describe, preferred timing | You |
| Call and message records | Calling number, date, time and length of calls to our tracking numbers; text messages and their delivery status; recordings only where we tell you at the start of the call | Our call-tracking and messaging providers, and social media platforms when you contact us there (for example, a lead form on Facebook or Instagram) |
| Consent records | The consent text you saw, whether you ticked each box, date and time, page address, IP address and browser type | Generated when you submit a form |
| Partner business information | Business details, trade, service area, billing contacts, invoices, closed-job reports | Partner businesses |
| Technical and usage data | IP address, browser type, pages visited, approximate location derived from IP; analytics only if you allow it | Your browser and our hosting provider’s server logs |
| Privacy request records | The request you made, how we verified it and how we answered | You and our records |
Sensitive information. We don’t ask for and don’t intend to collect sensitive personal information, such as Social Security numbers, financial account numbers, precise geolocation, health information, or information about race, religion or sexual orientation. Please don’t include it in a form or message. We don’t use any sensitive information to infer characteristics about you.
4. How we use it
- To answer your questions and send you the information or proposal you asked for.
- To provide the services our clients hire us for, and to invoice and support them.
- To pass your service request to the partner business that serves your area and trade, when you ask us to (see section 5).
- To run the partner program: match completed jobs to the requests that produced them, report to partners and invoice commissions.
- To keep records of consent and opt-outs, and to honor them.
- To keep our sites secure, prevent spam and fraud, and fix problems.
- To understand, in aggregate, which pages and sites work, using analytics only where you allow it.
- To comply with the law, respond to lawful requests and defend legal claims.
We don’t use your information for automated decisions that produce legal or similarly significant effects about you.
5. Who receives it
The partner business you ask to hear from
When you call a Network Site or submit a request on one, we send your contact details and request to the one partner business that serves that type of service in your area, so it can contact you about your request. The form tells you this before you submit it. If that business completes a job for you, it pays us a commission; we are not paid for passing on your request. Partner businesses must agree in writing to use your information only to respond to your request, to keep it secure, and to stop contacting you when you ask.
Service providers
Companies that process information for us under contract and only on our instructions: website hosting, email delivery, call tracking and telephony, text messaging, customer relationship management, analytics (only if you allow it) and accounting. They aren’t allowed to use your information for their own purposes.
Legal and safety reasons
When the law requires it, to respond to a valid legal process, to protect the rights, property or safety of anyone, or to investigate fraud or abuse.
Business transfers
If our business or a Network Site is sold, merged or reorganized, information may pass to the buyer, which must keep honoring this policy for that information.
We don’t sell information to data brokers, and we don’t share it with other businesses for them to market unrelated products to you.
6. Selling, sharing and targeted advertising
State privacy laws define “selling” and “sharing” broadly. Here is what we do, in plain terms:
- Lead routing. We disclose the request you submit on a Network Site to the partner business you asked to be connected with, and that business pays us a commission only on jobs it completes. Because you direct that disclosure, we don’t consider it a sale. Even so, we let you opt out of it: if you opt out, we won’t pass any further requests from you to a partner business, and we’ll ask the partner that already has your request to stop contacting you.
- Advertising. We don’t use cross-context behavioral advertising or targeted advertising today, and we don’t place advertising cookies. If that changes, we’ll update this policy and ask for your permission first.
- Analytics. Optional analytics only run if you allow them, and never when your browser sends Global Privacy Control.
You can opt out at any time on our Your Privacy Choices page, by email at info@nexuswaveagency.com, or by calling +1 (610) 234-7697. You don’t need an account and we won’t ask you to verify your identity to opt out.
7. Calls, text messages and consent
- Tracking numbers. Phone numbers on Network Sites are tracking numbers. Calls are forwarded to the partner business and we log the calling number, date, time and length so we can count and bill leads accurately.
- Recordings. If a call is recorded, you hear a notice at the start of the call and can hang up. Recordings are used only for quality control and to match calls to completed jobs.
- Consent. We or a partner will only call or text you with automated technology if you gave consent for that on our form. Giving consent is never a condition of buying anything. We keep a record of the consent text you saw and when you agreed.
- Opting out. Reply STOP to any text to stop texts, or tell the caller you don’t want more calls. You can also email or call us and we’ll pass your opt-out to the partner business. We honor opt-outs within the time the law requires, and as soon as we reasonably can.
- Mobile information. Text-message opt-in data and consent are never shared with third parties for their own marketing. Partner businesses receive your number only to answer the request you made.
8. Cookies and Global Privacy Control
We use a small number of essential cookies to remember your privacy choices. Our hosting provider may set technical cookies to protect the site from attacks. Optional analytics are off unless you turn them on. See our Cookie Policy for the full list.
Global Privacy Control (GPC). If your browser sends a GPC signal, we treat it as a valid request to opt out of the sale and sharing of your personal information and of targeted advertising, for that browser. We don’t load optional analytics for it. If we know who you are, for example because you’ve submitted a form, we apply the opt-out to your record too.
9. How long we keep it
| Information | How long |
|---|---|
| Partner program inquiries from this website | Up to 3 years after our last contact, unless you become a partner |
| Partner business records, contracts and invoices | For the relationship plus 7 years, for tax and accounting |
| Consumer service requests and call logs | Up to 3 years from the request, for billing, dispute resolution and fraud prevention |
| Call recordings (if any) | Up to 12 months |
| Consent and opt-out records | 5 years from the last consent or opt-out, to prove compliance |
| Privacy request records | At least 24 months |
| Server security logs | Usually up to 90 days |
When we no longer need information, we delete it or de-identify it so it can’t be linked back to you.
10. Your privacy rights
Residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia have privacy rights under their state laws, and more states are adding them. We give the following rights to every U.S. resident, whether or not your state’s law requires it or applies to us:
- Know and access: confirm whether we process your information, and get the categories and the specific pieces we hold, where we got it, why we use it and who we disclosed it to.
- Portability: receive your information in a common, machine-readable format.
- Correct: fix information that’s inaccurate.
- Delete: ask us to delete information we hold about you, subject to the exceptions the law allows, such as keeping proof of consent or records we need for taxes.
- Opt out of the sale and sharing of your information, of targeted advertising, and of profiling that produces significant effects. We don’t do the last two.
- Limit the use of sensitive information. We don’t collect it, so there’s nothing to limit, but you can still ask.
- Get a list of third parties to whom we have disclosed personal information, where your state provides this right.
- Appeal if we decline your request.
- Not be discriminated against for using any of these rights. We won’t deny you service, charge a different price or give you a different level of service because you used them.
11. How to use your rights
- Send your request through the form on Your Privacy Choices, by email to info@nexuswaveagency.com, or by calling +1 (610) 234-7697.
- We verify it’s you. For requests to access, correct or delete, we match the details you give us (usually your name plus the phone number or email you used) against our records. We may ask for one more piece of information. We only use what you give us to verify the request. Opt-out requests don’t need verification.
- We answer. We confirm receipt within 10 business days and answer within 45 days. If we need more time, up to another 45 days, we’ll tell you why. Requests are free; we may refuse or charge a reasonable fee only for requests that are clearly unfounded or excessive, and we’ll explain why.
Authorized agents
Someone else can make a request for you if you give them signed, written permission, or if they hold a power of attorney. We may ask you to confirm your identity with us directly. A parent or legal guardian can make a request for a child.
Appeals
If we decline all or part of your request, you can appeal by replying to our decision or by emailing info@nexuswaveagency.com with “Privacy appeal” in the subject line. We’ll answer within 45 days and explain our decision in writing. If we deny your appeal, you can contact your state Attorney General; the National Association of Attorneys General lists every office at naag.org/find-my-ag.
12. Additional information for certain states
California
Notice at collection. The categories of personal information we collect, the purposes, whether it is sold or shared, and how long we keep it are described in sections 3, 4, 6 and 9. In the past 12 months we collected the categories in section 3 from the sources listed there.
Disclosures in the past 12 months. For business purposes we disclosed identifiers, service request details, call records and internet activity to our service providers. We disclosed identifiers and service request details to partner businesses at the consumer’s direction, as explained in section 6. We haven’t sold or shared the personal information of anyone we know to be under 16.
Financial incentives. We don’t offer financial incentives in exchange for personal information.
Shine the Light. We don’t disclose personal information to third parties for their own direct-marketing purposes.
The California Privacy Protection Agency has more about your rights at cppa.ca.gov.
Nevada
We don’t sell covered information as defined by Nevada law. You can still send an opt-out request to info@nexuswaveagency.com and we’ll record it.
Colorado, Connecticut, Oregon, Texas, Virginia and other states with appeal rights
The appeal process in section 11 applies. We honor universal opt-out signals such as Global Privacy Control where these laws require it, and everywhere else too.
Washington and Nevada consumer health data laws
We don’t collect consumer health data as defined by these laws.
13. Children
Our websites are for adults and businesses. We don’t knowingly collect personal information from anyone under 18, and we never sell, share or use for targeted advertising the information of anyone we know is under 18. If you think a minor has given us information, contact us and we’ll delete it.
14. Security
We use encrypted connections (HTTPS) on all our sites, restrict access to people who need it, store form records outside the public web folder, and require our service providers and partner businesses to protect information. No system is perfectly secure, so we also keep only what we need. If a breach affects your information, we’ll notify you as the law requires.
15. Where information is handled
We store information on servers in the United States. Some of our team and service providers work from other countries, including in the European Union, and may access information from there under the same protections. If you are in the European Economic Area or the United Kingdom and contact us, you also have rights under the GDPR; write to us to use them.
16. Changes to this policy
We update this policy when our practices or the law change, and at least once a year. The date at the top shows the latest version. If we make a material change, such as starting to use information for a new purpose, we’ll post a notice on our websites and, where the law requires, ask for your consent first.
